MedNexus Health operates a private medical laboratory and a physician-led medical clinic. These Terms apply to everyone who uses the Site, including:

  • Individuals seeking laboratory testing or clinic services

  • Healthcare providers who send specimens to our laboratory or partner with us

These Terms cover your use of the Site itself. They do not replace any separate agreement you may enter into with us for clinical or laboratory services, and they do not replace the consent forms, service agreements, or provider agreements that govern those services directly.

2. Not medical advice

The content on this Site is provided for general information only. It is not medical advice, and it is not a substitute for professional diagnosis, treatment, or a relationship with a qualified healthcare provider.

Nothing on this Site creates a provider-patient relationship. Information about tests, services, or health topics is general in nature and may not apply to your individual circumstances. Always consult a qualified healthcare professional about your own health, and never disregard or delay seeking professional advice because of something you read here.

3. Laboratory and clinic services

3.1 How our services work

MedNexus provides private laboratory testing and physician-led clinical services. Where testing is offered directly to individuals, every test request is reviewed and overseen by a licensed physician before processing. This medical oversight is part of our service and is not optional.

A test request submitted through the Site is a request only. It is not confirmed until it has been reviewed, approved, and processed by our clinical team. We reserve the right to decline, modify, or require an in-person assessment for any request where clinical judgment indicates it is appropriate.

3.2 Availability of services

The services and features described on this Site are being introduced in phases and may not all be available at the time you visit. Descriptions of planned or upcoming services do not guarantee their availability. We may add, change, suspend, or discontinue any service at any time.

3.3 For healthcare providers

Providers who send specimens to our laboratory or partner with us are subject to the specific requirements we communicate directly, including requisition requirements, specimen handling, and applicable service arrangements. These Terms govern website use only and do not replace those arrangements.

3.4 Results

Where results are made available to you, they are provided through a secure third-party portal, not through this Site (see Section 7). Laboratory results are not a diagnosis. We recommend discussing your results with a qualified healthcare provider. You are responsible for keeping your account credentials and contact information accurate and secure.

4. Fees and payment

Where fees apply, they will be shown or communicated to you before you commit to a service. Prices are in Canadian dollars and may change. Unless stated otherwise or required by law, fees paid for services are non-refundable once a service has been rendered. Private testing and clinic services described on this Site are generally not covered by public health insurance (Medicare). Specific payment, cancellation, and refund terms for a given service will be provided at the point of that service.

5. Privacy and personal health information

Your privacy matters to us, and we handle personal health information in accordance with New Brunswick's Personal Health Information Privacy and Access Act (PHIPAA) and other applicable law.

How we collect, use, protect, and disclose your information is described in our [Privacy Policy], which forms part of these Terms. Please review it before submitting any personal or health information through the Site.

Certain results, such as positive results for specific communicable diseases, must be reported to public health authorities as required by New Brunswick law. This is a legal obligation and applies regardless of your consent preferences.

Some functions, such as account creation, appointment booking, and viewing results, are handled through third-party platforms, including our laboratory and clinic software providers. When you use those platforms, you are also subject to their own terms and privacy policies. We are not responsible for the content, security, or practices of third-party platforms and websites, even where we link to them.

7. Acceptable use

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms

  • Submit false, inaccurate, or misleading information

  • Attempt to gain unauthorized access to any part of the Site, its systems, or connected platforms

  • Interfere with or disrupt the Site, its security, or its availability

  • Use automated tools to scrape, copy, or collect content or data from the Site without our written permission

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for matters relating to the direct provision of healthcare services.

11. Indemnification

You agree to indemnify and hold harmless MedNexus Health and its directors, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the Province of New Brunswick and the applicable laws of Canada. Any dispute relating to these Terms or the Site will be subject to the exclusive jurisdiction of the courts of New Brunswick.
